Refund Policy
This Refund Policy explains the conditions under which fees paid to EMD Funders, LLC ("EMD Funders," "we," "us," or "our") may be refunded or are considered non-refundable. By submitting an application or engaging with our services, you agree to this Refund Policy.
1. Fee Structure Overview
EMD Funders charges two types of fees:
- Application Fee: Paid at the time of application submission. Covers deal review, underwriting, due diligence, and LLC formation if applicable.
- EMD Funding Fee: A percentage-based fee paid upon deal approval, before or on the day the EMD is funded. Based on the total EMD amount requested.

In addition to EMD Funders' fees, a separate preliminary title fee is charged by our title partner at the time escrow is opened. Title partner fees are not collected or managed by EMD Funders and are subject to our partner's own refund policy.
2. Application Fee Refund Conditions
The Application Fee is refundable only if your deal is not approved for EMD funding.
- Approved: If your deal is approved and you proceed, the Application Fee is non-refundable.
- Not Approved: If EMD Funders declines to fund your deal for any reason, your Application Fee will be refunded in full within 5 business days.
- Withdrawn Before Review: If you withdraw your application before review begins, your Application Fee may be refunded at EMD Funders' sole discretion.
3. EMD Funding Fee Refund Conditions
The EMD Funding Fee is generally non-refundable once paid.
- The EMD Funding Fee is due upon deal approval, before or on the day the EMD is funded into escrow.
- Once the EMD has been funded, the EMD Funding Fee is non-refundable regardless of deal outcome.
- If EMD Funders is unable to complete the funding after the fee has been paid (e.g., escrow rejection), a full refund of the EMD Funding Fee will be issued within 5 business days.
4. Title Partner Fees
Title and escrow fees charged by our designated title partner are separate from EMD Funders' fees. We do not collect title fees, and refund requests for those fees must be directed to the title partner.
5. Refund Method & Timing
- All eligible refunds will be issued to the original payment method.
- Refunds are typically processed within 5 business days of determination.
- Bank processing times may add 3 to 5 additional business days.
6. Force Majeure
EMD Funders is not responsible for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, government actions, or system outages.
7. Disputes
All refund disputes must be submitted in writing to legal@emdfunders.com. We will review and respond within 10 business days.
8. Changes to This Policy
EMD Funders may update this Refund Policy at any time. Any changes will be posted on this page with a new effective date. Continued use of our services after any change constitutes acceptance of the updated policy.
